Foreword
As a result of the meeting of the International Advisory Council on the creation and development of an international financial center, held on October 28, 2011, the Government of the Russian Federation, together with the Government of Moscow, was instructed to submit proposals for amending the legislation of the Russian Federation and the legislation of the city of Moscow in order to develop public-private partnership . The Government of the Russian Federation is currently developing a draft federal law aimed, among other things, at expanding the possible forms of project implementation on the principles of public-private partnership 1 . Until April 1, 2012, it was instructed to implement a number of measures to "improve the mechanism of budget investment carried out within the framework of public-private partnership through the Investment Fund of the Russian Federation, while paying special attention to the development of a list of criteria for selecting projects financed from the Fund's funds, the implementation of which should stimulate economic growth of Russian regions” 2 .

The smoldering global financial crisis causes a steady trend of reducing the budgetary possibilities not only of Russia, but of any state in the world in general against the backdrop of ever more progressive service and infrastructure needs of the population and business entities.

The process of urbanization in Russia, leading to the enlargement of megacities, is a reality today. Socio-economic development of the “new” Moscow (territories attached to it from the south and south-west), solving the eternal problem of the transport and infrastructure crisis, which is already associated with a clear collapse, bringing the Sochi Olympic sports infrastructure to perfection by 2014 and the Kazan Universiade sports infrastructure by 2013, the creation/modernization of sports infrastructures for holding the 2016 Ice Hockey and 2018 World Football Championships in Russia, ending the isolation of the Russian eastern regions from the rest of the country and the proper economic development of these regions, which is the key to maintaining the sovereignty and territorial integrity of the country , the implementation of many other large-scale, national-level projects - it is unrealistic to implement all this today only at the expense of budgetary resources alone. It can be said that the state forced attract the potential of the private sector to such projects. And we can say, and it will be, in our opinion, more methodologically true, that, based on the principle of democracy, the principle of the state-public nature of management in a number of areas of social relations (education, culture, healthcare, etc.), the principle of social justice , state must involve the potential of the private sector in the implementation, provision and protection of public interests.

Public-private partnership is an objectively determined trend of modern economic development. A lot of scientific monographs, dissertations, a great many scientific articles and journalistic materials, without counting news reports, have already been devoted to various aspects of public-private partnership. But in this sea of ​​opinions and information it is extremely difficult to navigate. Firstly, there are not so many really bright and fundamental scientific studies that put everything on the shelves, and in mediocre works you just “drown”. Secondly, many scientific “copies” have already been broken around this topic, but the discovery of “truth” is still too far away.

Coming out into the light with the approval of the Department of Administrative and Financial Law of the Peoples' Friendship University of Russia The scientific monograph by Vsevolod Sazonov “Public-Private Partnership: Civil Law, Administrative Law and Financial Law Aspects” fully meets the criteria for the quality of scientific research. The work is very relevant and, most importantly, it stands out significantly against the general background of existing works on this topic with its high scientific qualities, the extent of coverage and understanding of normative material and scientific sources.

In the presence of some shortcomings and debatable points, which no serious scientific research is devoid of, Vsevolod Sazonov's monograph has an undeniable scientific novelty and practical significance.

The presented scientific monograph by Vsevolod Sazonov is, first of all, a large comparative legal study, which has no analogues on the stated topic in Russia, and if there is, then there are few abroad.

Comparative legal research has always been considered in legal science, if not "aerobatics", then, in any case, an occupation that requires very considerable composure, painstaking and especially conscientiousness. As Otto Kon-Freud wrote, “the use of the comparative method requires knowledge not only of a foreign language, but also of the social, and above all political, context. The use of comparative law for practical purposes is wrong if it is carried out exclusively in the spirit of legalism, which ignores this context of law.

The topic of public-private partnership in this sense is burdened with particular complexity. In order to develop this topic at the proper scientific level, one should have excellent knowledge of administrative law, financial law, civil law, tax law, and one must also have deep knowledge of the general theory of law and economics. But even the most biased acquaintance with the work of Vsevolod Sazonov forces us to recognize the author's claim to serious knowledge in these scientific areas as justified.

Studies of foreign experience of public-private partnership are not new for domestic research on this topic. But at best, such works are a deep study of the experience of a maximum of one or two states. And in the absolute majority of cases, free retellings of foreign reviews of low quality are given, often based on outdated editions of regulations, without referring to original sources, without analyzing current regulations. Vsevolod Sazonov, from the standpoint of civil law, administrative law and financial law, seeks to explore foreign experience precisely on the basis of foreign sources, primarily normative ones, referring to their current versions, giving them an almost article-by-article analysis. Based on primary sources in original languages, this monograph analyzes in detail the features of the formation, development and current state of legal support and implementation of public-private partnerships in a significant number of foreign countries, including: Australia, Austria, Argentina, Belgium, Brazil, Great Britain, Germany , Denmark, Ireland, Spain, Italy, Canada, Mexico, Netherlands, New Zealand, Portugal, USA, France, Chile, Switzerland, Japan and many others. Such a view of the problem is worth a lot.

Introduction
The current state of an increasingly globalized world economy with new challenges determines the need for government bodies and municipal government bodies of many states to increasingly act in new roles for themselves, develop new models of both their own activities and interaction with other subjects of the economic sphere, look for more efficient forms of public service delivery in conditions of limited resources.

The low level of quality and underdevelopment of the housing and communal services infrastructure 3 , transport, telecommunications and other infrastructures are currently a significant barrier to the economic growth of our country.

At present, when the economic crisis has gripped many countries, the Russian state is forced to exert even greater influence in many sectors of the economy, but in the face of a reduction in the state's financial resources, its ability to implement long-term projects is significantly reduced. This circumstance requires the search and implementation of new forms of cooperation between the state and private economic entities - public-private partnership mechanisms 4 (Spanish - Colaboración público-privada or Asociación público-privada; English - Public-Private Partnership; French - Partenariat public- privé; German - Öffentlich-Private Partnerschaft; Italian - Partenariato Pubblico Privato; Danish - Offentlig-Private Partnerskaber).

The importance and even the need to use public-private partnership mechanisms is largely due to state budget crises, manifested in a lack of financial resources in the face of, on the one hand, an increase in the size of public debt and, on the other hand, an increase in public needs in the field of infrastructure support.

Public-private partnership projects in its various forms are actively gaining popularity in many countries as a tool for creating new infrastructure facilities, providing infrastructure and other public services, and for organizing public works.

At the same time, public-private partnership is not a new invention of today or the last 30 years. Despite the fact that this phenomenon has been presented in recent decades as a kind of invention, a real innovation at the international and national levels (primarily as a tool for infrastructure development), in reality, cooperation between the public and private sectors to create, provide and manage infrastructure, especially transport, has a long tradition in many countries of the world. The history of public-private partnership projects in Brazil, Spain, Italy, Mexico, the USA, France, and a number of other countries dates back several centuries.

In 19th-century Russia, the experience of using a concession was known. In 1836, Emperor Nicholas I granted a concession for the construction of a railway line from St. Petersburg to Tsarskoye Selo to Franz Anton von Gerstner. For the implementation of this project, the state allocated land plots free of charge and provided guarantees 5 .

The French author Xavier Besancon published a book in 2004 with a self-explanatory title - "2000 years of public-private partnerships for the construction of systems and public facilities" 6 . And, it must be admitted, his arguments in support of his thesis, reflected in the title of the book, are quite reasonable.

In the very first approximation, public-private partnership is a general concept that refers to a set of mechanisms for attracting resources, financial and organizational capabilities and efforts of the private sector by public authorities in the public interest 7 (that is, to achieve certain public goals) and covering a wide range of mutually beneficial commercial and organizational relations between the public (state, municipal) and private sectors, based on joint efforts to achieve the desired results for the public service sector (construction, renovation and operation of infrastructure facilities, provision of services, management). This concept is often used as a general term for a generalized designation of a number of agreements between the public sector and private organizations, but such a use of this concept is not entirely correct, since this mixes public-private partnership as a special form of interaction between the state and the private sector, which has a corresponding special content, with all other diverse forms of cooperation of these parties.

In Russia, not only the tasks of introducing and developing public-private partnership mechanisms and their legal support, which have already been declared as priority tasks by state leaders 8 , are being updated, but also the task of creating models (and methods) for recording and measuring the results and evaluating the effectiveness of public private partnership, in particular, assessing the effectiveness of the capital structure in public-private partnerships 9 , developing and implementing mechanisms to prevent some of the negative aspects that foreign states encountered when implementing public-private partnership schemes.

The Budget Message of the President of the Russian Federation on Budget Policy in 2011-2013 stated that “the state should not replace the private sector or choose promising areas of development for it ... The preferred form of support should be co-financing of certain projects or stimulating activities that contribute to modernization , within the framework of a public-private partnership. It is necessary to improve the efficiency of the use of public investments. Along with the tasks for which the state is fully responsible, they should become a catalyst for investing private sector funds in those areas and projects where, along with the use of budgetary funds, it is possible and expedient to attract extrabudgetary resources. At the same time, it is worth using the mechanisms of public-private partnership more intensively. " 10 .

At a press conference following the results of the APEC forum, President of the Russian Federation V.V. Putin noted that "among the achievements of APEC in 2012 are the implementation of initiatives that ensure closer interaction between the government and business, the formation of public-private partnerships on policy issues ... We are expanding infrastructure opportunities" 11 .

With the ever more active and large-scale use of public-private partnership mechanisms for the implementation of service-infrastructure and related security goals, the institution of public-private partnership, the issues of its legal support and implementation are becoming the object of close attention in the scientific monographic and scientific literature. , in dissertation research, in official reports and speeches.

The relevance of this study is also determined by today's discussions regarding the directions of the country's economic development, including the draft state program "Development of foreign economic activity" 12 , the draft state program "Federal property management" (for the period 2013-2015) 13 and a number of other projects of official program documents.

The need to adopt a federal law “On Public-Private Partnerships” is being discussed, and the relevant draft law has been posted for discussion on the website of the Ministry of Economic Development of Russia 14 .

The study of public-private partnership in a broad sense is also being updated in connection with the proposals of the Russian Ministry of Justice to legislate such organizational and legal forms as “state-public associations” and “public-state associations” 15 .

The topic of public-private partnership (both in general and in its individual segments) can hardly be called little studied, a great many works are devoted to it.

Biography

Evgeny Sazonov was born in Leningrad in 1936.

By the first education, a pediatrician. Evgeny Sazonov graduated from St. Petersburg State Pediatric Medical University and worked as a pediatrician for several years.

In 1951, he entered the drama circle with Matvey Grigoryevich Dubrovin, which determined his subsequent life and creative path.

He graduated from the B. V. Shchukin Theater School with a degree in drama director under Boris Evgenievich Zakhava.

Since 1974 (since the death of the founder of the Theater of Youth Creativity (TYUT) Matvey Dubrovin) has been the artistic director of TYUT.

Head of the project "The Future of Theater Education".

Among the students of E. Yu. Sazonov, pupils of TYuT are Nikolay Fomenko, Igor Gordin, Alexey Devotchenko, Oleg Dmitriev, Andrey Zibrov, Vladimir Bogdanov, Oleg Kulikovich, directors Vadim Fisson and Mikhail Chernyak, screenwriter Vladimir Vardunas, composer Vladislav Panchenko, lighting designers Evgeny Ganzburg and Gleb Filshtinsky and many other theater workers and people of various professions.
